1.1 These Terms of Service ("Terms") govern your access to and use of the Wister mobile application (the "App"), operated by DONATION POS L.P. (DONATION POS E.E.), a limited partnership registered under the laws of the Hellenic Republic (Greece), with registered office at El. Venizelou 218, Kallithea, 17675, Athens, Greece, GEMI registration number 178825503000, VAT number EL802572430 (hereinafter "Wister," "we," "us," or "our").
1.2 By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
1.3 Nature of the App. Wister is a private messaging application. The App is designed for private, one-to-one communication between Users who share each other's phone number and are saved in each other's device contacts. Wister is NOT a public social media platform, broadcasting service, or content marketplace. All interactions within the App — including messages, calls, stories, and gifts — occur exclusively between Users who are mutual contacts. There is no public profile, public feed, public gifting, or open discovery of users.
1.4 Wister is a technology company that sells digital content. Wister is NOT a payment institution, electronic money institution, bank, credit institution, or financial services provider as defined under Directive (EU) 2015/2366 (PSD2), Directive 2009/110/EC (EMD2), or any applicable national legislation including Greek Law 4537/2018 and Greek Law 4021/2011.
1.5 Discretionary Gift Repurchase. Wister may, at its sole and absolute discretion, offer to repurchase certain digital gift licenses (Gift Instances, as defined below) from eligible Users using Wister's own operating funds. This feature:
In these Terms, the following definitions apply:
"App" means the Wister private messaging application, including all related services, features, content, and updates provided by Wister. The App operates as a closed, contact-based communication platform where Users can only interact with other Users who are saved in their device's phone contacts.
"User" means any individual who creates an account and uses the App.
"Sender" means a User who sends a Gift to another User within the App.
"Recipient" means a User who receives a Gift from another User within the App.
"Rubies" means the digital items sold and licensed by Wister to Users within the App. Rubies are digital content — they are NOT electronic money, virtual currency, a financial instrument, stored value, or any form of monetary instrument under Directive 2009/110/EC, Directive (EU) 2015/2366, or any applicable national law. Rubies represent a limited, non-transferable, revocable license to access and use digital content within the App.
"Digital Items" means Rubies, Gifts, and any other digital content made available within the App.
"Gift" means a voluntary, gratuitous, and irrevocable transfer of a digital item from one User to another within a private chat in the App. When a Gift is sent, one or more Gift Instances are created and transferred to the Recipient. Gifts can only be sent between Users who are mutual contacts (i.e., each User has the other's phone number saved in their device contacts). Gifts are made without consideration or expectation of return.
"Gift Instance" means an individual, uniquely identified digital item created when a Gift is received. Each Gift Instance records the gift type, sender, date received, and Ruby cost. Gift Instances are owned by the Recipient and are distinct, trackable digital items — they are NOT a fungible balance, currency, or stored value. Wister may, at its sole discretion, elect to repurchase specific Gift Instances under Section 7.
"Ruby Inventory" means the total number of Rubies held by a User within the App.
3.1 You must be at least sixteen (16) years of age to create an account and use the App.
3.2 You must be at least eighteen (18) years of age to purchase Rubies or to be eligible for discretionary Gift Instance repurchase under Section 7.
3.3 Each individual may create and maintain only one (1) account. Creating multiple accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.
3.4 Account verification is performed via SMS to the phone number you provide during registration. You must have access to a valid mobile phone number to create and maintain your account.
3.5 By using the App, you represent and warrant that you meet the eligibility requirements set forth in this Section and that all information you provide is accurate and truthful.
3.6 Parental and Guardian Consent. Users between the ages of sixteen (16) and eighteen (18) may only use the App with the consent of a parent or legal guardian. By allowing a minor between 16 and 18 to use the App, the parent or legal guardian agrees to these Terms on behalf of the minor and accepts responsibility for the minor's use of the App. Users under the age of eighteen (18) are NOT permitted to purchase Rubies, receive repurchase offers, or engage in any financial transactions within the App.
4.1 Account Creation. Accounts are created using your mobile phone number, verified via SMS. You must provide accurate and complete information during registration and keep this information up to date.
4.2 Account Security. You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You agree to notify Wister immediately of any unauthorized use of your account.
4.3 Suspension and Termination. Wister reserves the right to suspend, restrict, or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent or suspicious activity, or for any other legitimate reason, subject to the provisions of Section 15 (Termination).
5.1 Nature of Rubies. Rubies are digital items sold and licensed by Wister. They are NOT electronic money, virtual currency, a financial instrument, or any form of stored value under Directive 2009/110/EC or Directive (EU) 2015/2366. Rubies represent a limited, non-transferable, revocable license to access and use digital content within the App. The purchase of Rubies constitutes a final sale of digital content from Wister to the User.
5.2 Pricing. Rubies are sold in packs. The current retail price of Rubies is 100 Rubies per 1.00 EUR (inclusive of applicable VAT). This price reflects the cost of digital content and does not establish any monetary value, exchange rate, or currency equivalence. Wister reserves the right to modify the pricing of Rubies at any time, with notice provided through the App. VAT is included in the displayed price and the applicable rate depends on the buyer's country of residence, in accordance with EU VAT rules.
5.3 Payment Methods. Rubies may be purchased using Stripe (credit/debit card), Apple Pay, Google Pay, or through In-App Purchases via the Apple App Store or Google Play Store. All payments are processed by licensed third-party payment providers. Wister does not directly process or store your payment card information.
5.4 Use of Rubies. Rubies may be used within the App to send Gifts to other Users, access in-app features, and access premium content, as made available by Wister from time to time.
5.5 Purchased Rubies vs. Gift Instances. The App distinguishes between two categories within your account:
Your account displays your Purchased Rubies balance and your owned Gift Instances separately.
5.6 No Refunds — Digital Content. The purchase of Rubies is non-refundable, except as required by applicable law. Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a purchase of digital content within fourteen (14) days of the transaction, provided that the digital content has not been delivered. However, by completing a purchase, you expressly consent to the immediate delivery of the digital content (Rubies) and acknowledge the following:
"I agree that the digital content is delivered immediately upon purchase and I acknowledge that I thereby waive my 14-day right of withdrawal pursuant to Article 16(m) of Directive 2011/83/EU."
This consent will be obtained explicitly at the point of purchase within the App.
5.7 Revenue. Payments received for Rubies constitute revenue of Wister. These funds are NOT held on behalf of any third party, are NOT segregated or ring-fenced for any User, and are NOT custodial funds.
5.8 In-App Purchase Platform Terms. Purchases of Rubies made through the Apple App Store or Google Play Store are subject to the respective platform's terms and conditions:
5.9 Virtual Items Disclaimer. Rubies, Gift Instances, and all other digital items within the App are digital content with no inherent real-world monetary value. They cannot be exchanged for legal tender, real currency, or any item of value outside the App, except solely where Wister, at its sole discretion, elects to repurchase certain Gift Instances under Section 7. Users have no right or entitlement to demand that Wister repurchase any Gift Instance. Rubies and Gift Instances are not redeemable, transferable (except as Gifts within the App), or exchangeable outside the App. Wister reserves the right to manage, regulate, control, modify, suspend, or eliminate Rubies, Gift Instances, and other digital items at its sole discretion, and Wister shall have no liability to you or any third party for exercising such rights.
6.1 Nature of Gifts. Sending a Gift is a voluntary, gratuitous, and irrevocable transfer of a digital item from one User to another within a private chat, with no expectation of consideration or return. Gifts can only be sent between Users who are mutual contacts — that is, each User must have the other's phone number saved in their device contacts. Gifts are NOT public; they are exchanged privately between individuals who know each other. Gifts are intended to celebrate special occasions such as birthdays, namedays, weddings, anniversaries, and other personal milestones. No money, funds, or monetary value is transmitted between Users at any point during a Gift transaction. Gifts involve only the transfer of digital items within the App.
6.2 How Gifts Work. Within a private chat between mutual contacts, the Sender selects a Gift from the catalog and sends it to the Recipient. The corresponding number of Rubies is deducted from the Sender's Ruby Inventory. For each gift sent, one or more Gift Instances are created in the Recipient's account. Each Gift Instance is a uniquely identified digital item that records the gift type, sender, date received, and Ruby cost. Gift Instances are owned by the Recipient as digital content. There is no public gift feed, public leaderboard, or public display of gifts.
6.3 No Payment Services. Wister does not provide payment services, money transmission services, or act as a payment intermediary between Users. No commission or fee is charged by Wister on Gift transactions between Users.
6.4 Irrevocability. Gifts are irrevocable once sent. A Sender cannot recall, reverse, or cancel a Gift after it has been transmitted to the Recipient.
6.5 Prohibited Gift Practices. The following practices are strictly prohibited and may result in account suspension or termination:
7.1 Nature. Wister may, at its sole and absolute discretion, offer to repurchase specific Gift Instances from eligible Users. This is a standard commercial buyback of identified digital items — not a payment service, not a balance conversion, not a currency exchange, and not a redemption of stored value. Wister uses its own operating funds to repurchase Gift Instances at commercially determined rates. No User has any right, entitlement, or expectation to have any Gift Instance repurchased.
7.2 Eligibility. To be considered for a discretionary repurchase offer, a User must:
Wister reserves the right to impose additional eligibility criteria at any time.
7.3 How It Works.
7.4 Pricing. The repurchase price offered by Wister is determined by Wister's internal commercial pricing model. The repurchase price is always LESS than the original retail purchase price of the underlying Rubies. Wister does not disclose the specific formula or per-item rates. Wister may apply an administrative processing fee, the amount of which may vary and will be disclosed at the time of any offer.
7.5 Payment. Approved repurchase amounts are paid via PayPal or other payment methods determined by Wister. Users must provide valid payment details. Processing times are subject to Wister's internal review processes.
7.6 Effect of Repurchase. Upon approval, the selected Gift Instances are permanently removed from the User's account and cannot be recovered, restored, or reversed.
7.7 Rejection. If Wister rejects a repurchase request, the Gift Instances are returned to the User's account and may be submitted in a future request. Wister is not obligated to provide a reason for rejection.
7.8 Tax Compliance.
7.9 Anti-Fraud Measures.
7.10 No Guaranteed Rights.
7.11 Modification and Discontinuation. Wister reserves the right to modify, suspend, or permanently discontinue the repurchase feature at any time, with or without notice, for any reason. Wister will make reasonable efforts to process approved requests before discontinuation. The terms in effect at the time of request submission apply to that request.
8.1 You are solely responsible for determining and fulfilling any tax obligations that may arise from your use of the App, including but not limited to gift tax, income tax, or any other tax applicable in your jurisdiction.
8.2 Wister does not provide tax, legal, or financial advice. You should consult a qualified tax professional regarding your individual circumstances.
8.3 Wister may be required to report certain transaction information to tax authorities under applicable regulations, including but not limited to Directive 2021/514/EU (DAC7) and Greek tax reporting obligations.
9.1 You agree not to use the App for any of the following purposes or activities:
9.2 Violation of these rules may result in immediate account suspension or termination, forfeiture of privileges, and, where appropriate, referral to law enforcement authorities.
9.3 Automated Detection. Wister uses automated systems to monitor transaction patterns for potential abuse. These systems may flag accounts for manual review based on activity thresholds. If your account is flagged, you may be contacted for additional verification.
10.1 User-Generated Content. You retain ownership of the content you create within the App, including messages, stories, and profile information. By posting or transmitting content through the App, you grant Wister a limited, non-exclusive, royalty-free license to display, transmit, and process that content as necessary to operate and provide the App's services.
10.2 Stories. Stories posted within the App are visible to your contacts for twenty-four (24) hours, after which they are automatically deleted from our servers.
10.3 Encrypted Messages. Chat messages within the App are protected by End-to-End Encryption. Wister cannot read, access, or monitor the content of encrypted messages.
10.4 Reporting. Users may report content or accounts that they believe violate these Terms or applicable law. Wister will review reports and take appropriate action, which may include content removal, account restriction, or account termination.
10.5 Push Notifications. The App may send you push notifications, including but not limited to: new messages, gift notifications, celebration reminders, and service announcements. You may disable push notifications at any time through your device settings. Disabling push notifications may affect your ability to receive timely updates about gifts and messages.
11.1 The App, including its design, source code, graphics, user interface, logos, and branding, is owned by Wister and is protected by applicable intellectual property laws, including copyright and trademark law.
11.2 Subject to your compliance with these Terms, Wister grants you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial purposes.
11.3 "Wister" and the Wister logo are trademarks of DONATION POS L.P. You may not use these marks without our prior written consent.
12.1 Your privacy is important to us. Our collection, use, and processing of your personal data is governed by our separate Privacy Policy, available at https://www.wister.site/privacy.
12.2 Wister processes personal data in compliance with the General Data Protection Regulation (EU) 2016/679 ("GDPR") and Greek Law 4624/2019.
12.3 In the course of providing the App's services, your data may be processed by third-party service providers, including Stripe, PayPal, Apple, and Google. These providers operate under their own privacy policies and terms, and you are encouraged to review them.
13.1 THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.2 WISTER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
13.3 Nothing in these Terms excludes or limits your rights under mandatory EU consumer protection laws, including but not limited to Directive 2011/83/EU on consumer rights and Directive 93/13/EEC on unfair terms in consumer contracts, as transposed into Greek law by Law 2251/1994.
13.4 Wister relies on third-party services including but not limited to Stripe, PayPal, Apple, Google, Firebase, and Agora to provide certain features of the App. Wister is not responsible for the availability, accuracy, security, or functionality of these third-party services and disclaims all liability arising from their use, to the extent permitted by applicable law.
14.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISTER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO WISTER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WISTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR INTERRUPTION OF SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
14.3 This limitation does not apply to the extent prohibited by applicable EU law, including mandatory consumer protection provisions under Directive 93/13/EEC as transposed into Greek law by Law 2251/1994.
15.1 Termination by User. You may delete your account at any time using one of the following methods:
Upon requesting account deletion, your account will be deactivated immediately and all personal data will be permanently deleted from our active systems within thirty (30) days. Data is removed from encrypted backup systems within ninety (90) days. Certain financial transaction records may be retained in anonymized form as required by applicable tax and anti-money laundering legislation (see our Privacy Policy, Section 6 for full details).
15.2 Termination by Wister. Wister may suspend or terminate your account if you violate these Terms, engage in fraudulent or suspicious activity, or for other legitimate reasons. Except in cases of serious violations requiring immediate action, Wister will provide reasonable prior notice before termination.
15.3 Effect of Termination.
16.1 Informal Resolution. Before initiating any formal legal proceedings, you agree to contact Wister at legal@wister.site to attempt to resolve the dispute informally. Wister will make reasonable efforts to resolve the matter within thirty (30) days.
16.2 Governing Law. These Terms are governed by and construed in accordance with the laws of the Hellenic Republic (Greece) and applicable European Union law.
16.3 Jurisdiction. Any disputes that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the competent courts of Athens, Greece, without prejudice to your rights under mandatory EU consumer protection laws to bring proceedings in your country of residence.
16.4 EU Online Dispute Resolution. If you are a consumer residing in the European Union, you may use the EU Online Dispute Resolution (ODR) platform to resolve disputes online. The ODR platform is available at: https://ec.europa.eu/odr.
16.5 Greek Consumer Ombudsman. If you are a consumer residing in Greece, you may also address complaints to the Greek Consumer Ombudsman (Synigoros tou Katanaloti). More information is available at: https://www.synigoroskatanaloti.gr.
17.1 Wister may update or modify these Terms from time to time. We will notify you of material changes through the App or by other appropriate means.
17.2 Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.
17.3 If you do not agree with the updated Terms, you must stop using the App and may delete your account in accordance with Section 15.1.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
