This Gift & Repurchase Policy ("Policy") is a binding supplement to the Terms of Service between you ("User," "you," or "your") and DONATION POS L.P. (DONATION POS E.E.), a limited partnership registered under the laws of the Hellenic Republic (Greece), operating the Wister private messaging application ("Wister," "we," "us," or "our").
This Policy governs the discretionary repurchase of Gift Instances by Wister under the Gift Repurchase Program described in Section 7 of the Terms of Service. By submitting a repurchase request, you agree to be bound by this Policy, in addition to Wister's Terms of Service, Privacy Policy, and Community Guidelines.
Capitalized terms not defined in this Policy have the meanings given to them in the Terms of Service. Additionally:
"Gift Instance" means an individual, uniquely identified digital item created when a User receives a Gift from another User within the App. Each Gift Instance records the gift type, sender, date received, and Ruby cost. Gift Instances are digital content owned by the Recipient — they are NOT a fungible balance, currency, stored value, or financial instrument.
"Repurchase Request" means a formal request submitted by a User through the App, offering specific Gift Instances for repurchase by Wister. Submission of a request does not create any right or entitlement to have the Gift Instances repurchased.
"Indicative Range" means the non-binding, estimated price range displayed to the User for selected Gift Instances prior to request submission. The indicative range is subject to change and does not constitute an offer, guarantee, or commitment by Wister.
"Final Approved Amount" means the amount determined by Wister, at its sole discretion, to be paid to the User for approved Gift Instances. The Final Approved Amount shall not exceed the indicative maximum.
"Gift Repurchase Program" or "Program" means the optional program through which Wister may, at its sole and absolute discretion, offer to repurchase specific Gift Instances from eligible Users at commercially determined rates, as described in this Policy and Section 7 of the Terms of Service.
"Rubies" are digital content items purchased within the App. Rubies have no monetary value, are not redeemable for cash, and do not represent stored value, electronic money, or a financial instrument under Directive 2009/110/EC (EMD2) or Directive (EU) 2015/2366 (PSD2).
2.1 The Gift Repurchase Program is a standard commercial buyback of specific, identified digital items by Wister. It is NOT:
2.2 Wister repurchases Gift Instances using its own operating funds at commercially determined rates. No User has any right, expectation, or entitlement to demand that Wister repurchase any Gift Instance.
2.3 Users should NOT use the App, send Gifts, or receive Gifts with the expectation of generating income through the Gift Repurchase Program. The App is a private messaging platform. The Program is supplementary and entirely discretionary.
To submit a repurchase request, you must meet ALL of the following requirements:
Wister reserves the right to modify eligibility requirements at any time.
Through the App, you may select specific owned Gift Instances that you wish to offer for repurchase. Only Gift Instances that meet the eligibility requirements (status "owned", minimum holding period met) are selectable. You may select between 1 and 50 Gift Instances per request.
Upon selection, Wister displays a non-binding indicative price range for the selected Gift Instances. This range:
If you choose to proceed, you submit a repurchase request. Upon submission:
All repurchase requests are subject to manual review. During review, Wister may:
Review may take fifteen (15) to thirty (30) business days.
If Wister approves a request, Wister determines the Final Approved Amount at its sole discretion. The Final Approved Amount:
Approved repurchase amounts are paid via PayPal. You must provide a valid, verified PayPal email address. Processing time is fifteen (15) to thirty (30) business days from approval.
Upon approval and payment:
If Wister rejects a request:
5.1 When Required. Identity verification is required for cumulative repurchase amounts exceeding €100, or as otherwise determined by Wister based on risk assessment.
5.2 How It Works. Identity verification is performed via Stripe Identity, a licensed third-party verification service. You will be asked to:

5.3 What Wister Receives. Wister receives only the verification result (verified / not verified) and basic identity information (name, date of birth, country). Wister does NOT store your identity documents or biometric data. For details on how Stripe processes your data, see Stripe's Privacy Policy.
5.4 Tax Documentation. For cumulative repurchase amounts exceeding DAC7 thresholds (30 transactions or €2,000 per calendar year), Wister may require you to provide a tax identification number (AFM, TIN, or equivalent) and complete applicable tax forms.
5.5 Data Retention. KYC verification results and tax documentation are retained for a minimum of seven (7) years from the date of the last transaction, as required by applicable anti-money laundering legislation (Directive (EU) 2015/849), Greek tax law (Law 4174/2013), and DAC7 reporting obligations. This retention period applies regardless of whether you withdraw from the Program or delete your Wister account.
5.6 Your Rights. Subject to applicable legal retention requirements, you have the right to access, rectify, and request erasure of your verification data. Erasure requests may be denied where retention is required by law. Contact privacy@wister.site to exercise your rights.

Wister reserves the right to modify these limits at any time. The limits in effect at the time of request submission apply to that request.
7.1 The repurchase price is determined by Wister's internal commercial pricing model. This model applies a spread from the retail price of the underlying Rubies, reflecting the commercial nature of the buyback and the inherent depreciation of digital content.
7.2 The pricing model may consider multiple factors, including but not limited to:
7.3 The repurchase price is NEVER equal to the original retail purchase price and is always LESS than the retail cost of the underlying Rubies.
7.4 Wister does not disclose the specific pricing formula, per-Ruby rates, spread percentages, or individual pricing components. Users are only shown a total indicative range for their selected Gift Instances.
7.5 Pricing may vary per User, per request, per Gift Instance, and over time. There is no fixed or guaranteed rate.
8.1 Monitoring. Wister employs automated and manual fraud detection systems to monitor gift and repurchase patterns. Your account activity is subject to ongoing review.
8.2 Risk Scoring. Wister maintains an automated risk scoring system that assigns a numerical risk score (0–100) to user accounts based on detected activity patterns. The score is based on configurable thresholds and does NOT involve profiling based on personal characteristics such as race, ethnicity, religion, gender, or political beliefs.
8.3 Consequences of High Risk. Accounts that exceed risk thresholds may be subject to:
8.4 Prohibited Practices. The following are strictly prohibited and may result in permanent removal from the Program, account suspension, and referral to law enforcement:
8.5 Chargebacks. If a Ruby purchase associated with Gifts you received is subject to a chargeback or payment dispute, Wister reserves the right to: freeze pending repurchase payments, reject pending requests, deduct corresponding amounts from future repurchase eligibility, and suspend Program participation.
8.6 Your Rights (GDPR Article 22). You have the right not to be subject to a decision based solely on automated processing that significantly affects you. All consequential actions (payout freeze, removal from Program, account termination) involve human review. You may contact privacy@wister.site to request information about risk flags on your account or to contest a decision.
9.1 Wister is committed to preventing the use of its platform for money laundering, terrorist financing, or other financial crimes, in compliance with:
9.2 By submitting a repurchase request, you represent and warrant that:
9.3 Wister reserves the right to report suspicious transactions to the Hellenic Financial Intelligence Unit (FIU) or other competent authorities without prior notice to you, as required by law.
9.4 Sanctions. Wister may refuse to process repurchase payments, suspend participation, or terminate Program access for Users located in, nationals of, or otherwise associated with countries or territories subject to comprehensive financial sanctions by the EU, UN, US (OFAC), or the Hellenic Republic. The list of restricted jurisdictions may change without prior notice.
9.5 Failure to comply with this section will result in immediate removal from the Program, forfeiture of all pending repurchase requests, and may result in account termination and referral to law enforcement.
10.1 You are solely responsible for determining and fulfilling all tax obligations arising from repurchase payments received, including income tax, VAT, social security contributions, and any other taxes applicable in your jurisdiction.
10.2 Wister does not provide tax, legal, or financial advice. You should consult a qualified tax professional regarding your individual circumstances.
10.3 Wister will issue appropriate tax documentation as required by applicable law.
10.4 DAC7 Reporting. Under Directive 2021/514/EU (DAC7) and applicable Greek tax law, Wister is required to report User information to relevant tax authorities where a User receives repurchase payments exceeding:
10.5 Wister may require you to provide a tax identification number and complete applicable tax forms before processing repurchase payments. Failure to provide requested documentation may result in suspension of payment processing.
11.1 No Entitlement. The Gift Repurchase Program does NOT create any contractual right, entitlement, or obligation for Wister to repurchase any Gift Instance from any User.
11.2 Full Discretion. Wister retains full and absolute discretion to:
11.3 Not a Currency Exchange. The Program is NOT a currency exchange, balance conversion, withdrawal mechanism, or redemption of stored value. Gift Instances are digital content items. Repurchase is a commercial buyback of specific digital items by Wister from its own funds at commercially determined rates.
11.4 No Income Expectation. Users should NOT use the App, send Gifts, or receive Gifts with the expectation of generating income through the Gift Repurchase Program. The App's primary function is private messaging between mutual contacts. The Program is supplementary and entirely discretionary.
11.5 Variation. Repurchase terms, rates, and outcomes may vary:
12.1 By Wister. Wister may suspend or revoke your access to the Gift Repurchase Program at any time, with or without cause, including but not limited to:
12.2 By User. You may stop participating in the Program at any time by simply not submitting repurchase requests. To formally withdraw, contact legal@wister.site. Withdrawal does not affect any repurchase requests that have already been approved.
12.3 Effect of Removal.
13.1 Wister's total liability under this Policy shall not exceed the total repurchase payments actually paid to you in the twelve (12) months preceding the event giving rise to the claim.
13.2 Wister shall not be liable for delays in repurchase processing caused by: incomplete or inaccurate information provided by you, third-party payment provider issues, regulatory requirements, sanctions compliance, or fraud investigations.
13.3 This limitation does not apply to the extent prohibited by applicable EU law, including mandatory consumer protection provisions.
Wister reserves the right to modify this Policy at any time. Material changes will be communicated through the App or via email. The policy version in effect at the time of request submission applies to that request. If you do not agree with changes, you may stop submitting repurchase requests.
Wister reserves the right to modify, suspend, or permanently discontinue the Gift Repurchase Program at any time, for any reason, including but not limited to regulatory changes, business decisions, or platform strategy. Wister will make reasonable efforts to process approved repurchase requests before discontinuation.
16.1 This Policy is governed by the laws of the Hellenic Republic (Greece) and applicable European Union law.
16.2 Disputes shall be resolved in accordance with the dispute resolution provisions in the Terms of Service (Section 16).
16.3 If you are a consumer residing in the EU, you may use the EU Online Dispute Resolution platform.
